Terms of and Conditions of Sale

Tingley Monuments Ltd., duly incorporated Company under and by Virtue of the laws of the Province of New Brunswick and having its head office in the Town of Sussex, in the County of Kings and Province of New Brunswick, (hereby called the Vendor). AND: The Purchaser covenants and agrees that the following terms and conditions are terms and conditions of Sale as contained in the sales contract herein.

1. The Vendor hereby covenants and agrees to correct any spelling mistakes, dates, and design error if these mistakes and errors are the mistakes and errors of the Vendor and at his expense and at his earliest convenience.
   Incorrect information received by the Vendor from the Purchaser which results in a mistake in the manufacture of the Monument will be corrected by the Vendor at the Purchaser; s expense and at the Vendor’s convenience.
2. The purchaser covenants and agrees to mark the location of the Monument in the Cemetery and to maintain the marker tag or stake until the Vendor is able to deliver the Monument in Place.
3. The vendor may in its absolute discretion use a longer tablet (Monument) of lesser height to provide sufficient space for inscriptions, if the inscriptions are of greater length than the Monument Ordered.
   The Vendor undertakes to provide equal area on the surface of the Monument., The Vendor undertakes to produce a Monument of thickness not less than 3/8 inch less than the size marked on the order.
4. The Vendor does not guarantee to match color and texture of Monuments to duplicate precious orders, however the Vendor does undertake to choose granite from this granite stocks which will, in its opinion most closely match colors and textures of Monuments when an order is to duplicate a previous order.
5. The Vendor covenants and agrees to make appropriate adjustments from the Invoice Price when the Vendor for not complete the Monument Order.
   The Vendor does undertake to complete the work at a later date at its convenience.
6. The Vendor accepts no responsibility for damages to a Monument after delivery to the site.

Buyer’s right to cancel.

You may cancel this contract from the day you enter the contract until 10 days after you receive a copy of the contract. You do not need a reason to cancel.

If you do not receive the goods or services within 30 days of the date stated in the contract, you may cancel the contract within one year of the contract date. You lose that right if you accept delivery after 30 days. There are other grounds for extended cancellation. For more information, you may contact your provincial/territorial consumer affairs office.

If you cancel this contract, the seller has 15 days to refund your money and any trade-in, or the case value of the trade-in. you must then return the goods.

To cancel, you must give notice of cancellation at the address in this contract. You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax, or by personal delivery.

Shipping Policy

Please note that our shipping policy requires the designated address to be a cemetery within the specified postal code upon entering our site.

We specialize in delivering to resting places and do not facilitate installations to residential addresses. For a successful order, kindly ensure that the shipping address corresponds to a cemetery location within the indicated postal code. Thank you for your understanding.

Approval of Design

• The purchaser is responsible for the layout of lettering.
• The purchaser verifies the spelling of all names, words, and text.
• The purchaser verifies the accuracy of all dates.

The purchaser understands that by confirming the above, they take full responsibility for the accuracy of the provided information and approve it for finalization.

Flagging Instructions

• The monument MUST meet Cemetery Restrictions. Some cemeteries place restrictions on sizes or types of monuments. Make sure the Monument you are choosing fits within their restrictions and guidelines.

• There may be additional fees charged by the cemetery. These fees are the responsibility of the purchaser and are not covered by Tingley Monuments.
